Terms and Conditions

These terms are an agreement between you and Adsvercity. They cover the website, the listings on it, the screens we place inside local businesses and every paid service we offer. By creating an account, posting a listing or buying an advert you accept them. If you do not accept them, please do not use the service.

1. Who we are

Adsvercity is a local classifieds marketplace and advertising network based in Toronto, Ontario. We run this website and a network of screens placed inside independent businesses across the Greater Toronto Area and the surrounding towns. Where these terms say we, us or our, they mean Adsvercity.

2. Your account

You must be at least eighteen years old to hold an account. Give us accurate details when you register and keep them up to date, because we use them to reach you about your listings and your payments.

You are responsible for what happens under your account, so keep your password to yourself. Tell us straight away if you think somebody else has got into it. One person or business, one account. Creating extra accounts to get around a suspension is not allowed.

3. Posting listings

Classified listings are free. You may post as many as you genuinely have, and we take no commission on what you sell.

What you post must be accurate. Describe the item honestly, use photographs of the actual thing you are selling and set a real price. Put your listing in the right category and the right area so people can find it.

You must have the right to sell whatever you list. Do not post anything illegal, stolen, counterfeit or unsafe. That includes weapons, drugs and prescription medicine, live animals, tobacco and vaping products, adult material, recalled goods, and anything that infringes somebody else’s trademark or copyright. We also do not allow pyramid schemes, cryptocurrency offers, loan offers or listings whose real purpose is to collect personal information.

Keep it civil. No abuse, harassment, hate speech or content that targets a person or a group.

4. Deals between users

This is the part people most often misunderstand, so it is worth being clear. We are a place where neighbours find each other. We are not the buyer, we are not the seller and we are not an agent for either of you.

We never hold your money, we do not process payment between you and the other person, and we do not inspect, store or deliver anything listed here. Any agreement you reach is between the two of you, and so is any dispute about it.

Please read our safety guidance before you meet somebody. Meet in a public place, look at the item before you pay and never send money to a person you have not met.

5. Paid adverts on our screens

Banner and video spots are sold per shop for a run of seven days, which begins when we approve the advert rather than when you pay. The price you see at checkout is the price per shop multiplied by the number of shops you selected.

Every submission is reviewed by a person before it appears on any screen. We may decline anything that breaks the rules in section three, is poor enough quality that it will not read on a screen, or does not suit the businesses hosting our screens. If we decline your advert before it runs, we refund you in full.

Nothing renews automatically. When your seven days end the advert simply stops, and you can buy another run whenever you choose.

Screens are physical objects in premises we do not own. Power cuts, network problems, a shop closing early or a screen being switched off can interrupt a run. We do our best to keep them going and to tell you when something is wrong, but we cannot promise uninterrupted display. Where a screen is dark for a meaningful part of your run, contact us and we will extend the run or refund the affected portion.

6. Hosting a screen and getting paid

If you host one of our screens in your business, you keep a share of the price of every banner and video sold on that screen. The current share is 80% and it is shown in your dashboard. We may change the share for future sales, but never for money already recorded as owed to you.

Payouts are made once a month to the bank account you connect through Stripe, our payments provider. You will need to complete their identity checks before we can pay you, and until you do, anything you have earned is simply held for you. Balances below the minimum payout roll over to the following month.

You agree to keep the screen powered on and visible during your normal opening hours, to leave the software running and not to alter what it displays. Either of us may end the arrangement at any time with reasonable notice. If you stop hosting, we still pay you everything you have already earned.

You are responsible for any tax due on what you earn.

7. Payments and refunds

Prices are shown in Canadian dollars and include any applicable tax unless we say otherwise. Payment is taken at checkout through our payment provider, and we do not store your card details.

Because a paid spot is a short scheduled run, we cannot refund it once it has started, except where we decline your advert, where we cancel it ourselves, or where a screen failure meant your advert did not run as agreed. If you think something went wrong, contact us within thirty days and we will look at it properly.

We may change our prices at any time. A change never affects a run you have already paid for.

8. Your content

Everything you upload stays yours. By posting it you give us permission to show it on this website, on our screens and in our own promotion of the service, for as long as your content is live with us. You confirm that you own it or have permission to use it, and that showing it does not break anybody else’s rights.

Our own name, logo, software and design remain ours. Please do not copy the site, scrape the listings or use automated tools to collect data from it.

9. Privacy

We collect only what we need to run the service, such as your name, your email address and the details of what you post or buy. We do not sell your personal information.

Messages between users stay on the site so there is a record if something goes wrong. Your phone number and address are never published unless you choose to put them in a listing yourself. Our payment provider handles card details and bank details, and we never see or store them.

10. Removing content and closing accounts

We may remove a listing, decline an advert or suspend an account that breaks these terms, and we will tell you why when we do. Serious or repeated breaches can mean losing your account for good.

You can close your account whenever you like. If you do, we remove your listings, and we still pay you anything you have already earned as a screen host.

11. What we can and cannot promise

We work hard to keep the site and the screens running, but we provide them as they are. We cannot promise that the service will never be unavailable, that every listing is accurate, or that advertising with us will produce a particular number of customers or sales.

We are not responsible for what other users do, for the condition of anything sold here, or for anything that happens when two people meet to complete a deal. To the extent the law allows, our total liability to you for anything connected with the service is limited to the amount you have paid us in the twelve months before the problem arose.

Nothing here takes away rights you have under Canadian consumer protection law that cannot be signed away.

12. Changes to these terms

We may update these terms as the service grows. When we do, we change the date at the top of this page, and for anything significant we also tell account holders by email. Carrying on using the service after a change means you accept the new version.

13. Which law applies

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, and the courts of Ontario deal with any dispute. If a court finds one part of these terms unenforceable, the rest still stands.

14. Talking to us
